GAMES ON DEMAND PRIVACY POLICY

SureWest Communications ("SureWest") is the Service Provider of the SureWest Games on Demand Service, using technology and services provided by Exent™ Technologies Inc. This Privacy Policy explains how SureWest and Exent collect, use, and protect your information in relation to the Service, as defined in the Terms and Conditions. Please note that by accessing the Service, you are agreeing to the terms of the SureWest Games on Demand Service privacy policy, which may differ from the terms in the privacy policy of other SureWest service offerings.

OVERVIEW
NEITHER SureWest NOR EXENT WILL PROVIDE YOUR PERSONAL INFORMATION TO ANY THIRD PARTY WITHOUT YOUR EXPRESS WRITTEN CONSENT TO DO SO. OUR COLLECTION AND USE OF PERSONAL AND NON-PERSONAL INFORMATION IS SOLELY FOR THE PURPOSES OF PROVIDING A GREAT SERVICE TO YOU, SUPPORTING YOU IF YOU HAVE A PROBLEM, AND MAKING THE SERVICE BETTER.

WHAT PERSONALLY IDENTIFYING INFORMATION DO WE COLLECT?
Personal information that you provide when using the service may include, but may not be limited to, any of the following: name, e-mail address, and billing information. We may also explicitly ask you to tell us about yourself by, for example, surveying you to understand more about your preferences and how you would like to see the service improved.

HOW DO WE USE YOUR PERSONALLY IDENTIFYING INFORMATION?

SureWest and Exent may use your personal information to:

- Provide the service you have signed up for in the best possible manner.
- Improve the service.
- Provide customer support.

CHILDREN UNDER THE AGE OF 13
We will not knowingly collect personally identifying information from any person aged 13 and under. In order for children 13 years old and under to participate in the services on the site, we require that a parent or legal guardian register for the service and manage the account. SureWest and Exent encourage parents to instruct their children to never give out personal information when online.

Parents who are concerned about the transfer of personally identifying information from their children may contact us at through our online customer support to make a request to delete such information (subject to proper verification of parental authority). Once we are so notified we will delete such information.

We do not knowingly collect personally identifiable information from anyone under the age of 18 on the Service unless expressly specified on the appropriate pages of the Service website. On those pages, we will provide a special notice or other information describing any additional privacy protections that may apply.

Children should always get permission from a parent or legal guardian before sending any information about themselves (such as their names, e-mail addresses, and telephone numbers) over the Internet, to us or to anyone else.

WHAT NON-PERSONALLY IDENTIFIABLE INFORMATION DO WE COLLECT?
We collect the non-personally identifying information through your voluntary submission to us and through the following technology

(1) Use of a software technology called "cookies."
(2) Use of an "Active X" control that resides on your computer.
(3) Logging of session information in a server database.

A cookie is a small amount of data that is stored on your machine through the browser, by a web site. The information stored can only be accessed by the storing web site (to protect your privacy), and if your browser's preferences allow it. Cookies can enable automatic logins for example.

An ActiveX control is a small software program that can provide information about your machine as more fully described below.

Technical information about your computer will be transmitted to our servers. We use this information to optimize your experience of our products and services. The technical information we collect includes what kind of computer you have, your operating system, your video card, and other system components. We then compare your computer against the requirements of the game/software application you have selected to use. If your computer does not meet the requirements of the application, our digital delivery system will attempt to warn you in advance so that your computer will not have performance issues. While these methods help to insure a good game experience, we cannot guarantee that you will not encounter a problem. We retain aggregated information on the types of systems our users have for purposes of selecting new games which will be playable by the majority of our audience, given their system capabilities. The technical information collected is solely for the purpose of providing you with a better experience and is not used in conjunction with or provided to any third parties.

The technology used to power SureWest Games on Demand collects session information when you use a game/software application and transmits it to our servers. This information includes, for example, what title was played, how long it was played, pre-caching time, total caching time, amount of data downloaded, date of play, time of play, the type of play license that was used, machine ID, and error information on any technical problems which occurred. This information is used to provide you with customer support, license renewals, machine limited licenses, time based billing, and to enable us to provide the game publishers with royalty calculations. Your session information may be aggregated with the session information of other users to provide statistical reports to licensors of the applications and other third parties, including Verizon. No personally identifying information will be disclosed to any third party.

SHARING OF INFORMATION
Neither SureWest nor Exent will sell personally identifying information or share it with other third parties except as described herein.

SureWest or Exent may occasionally hire other companies to provide limited services on our behalf, including packaging, mailing and delivering purchases, answering customer questions about products or services, sending postal mail and providing billing and collection services. We will only provide these companies the information reasonably required to perform the service, and they will be prohibited from using that information for any other purpose.

Third party web sites and companies with links to and from the site may collect personally identifying information about users. We do not control the terms of service, practices or privacy policies of third parties that have web sites linked to the site and Exent's privacy policy does not extend to these external web sites and companies. Please refer directly to these companies and web sites regarding their privacy practices. Neither SureWest nor Exent assumes responsibility or liability for the actions of such third parties with respect to their use of your information or otherwise.

SureWest or Exent may disclose your personally identifying information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process or any governmental request; (b) protect and defend the rights or property of SureWest, Exent or their affiliated companies; (c) enforce the Terms of Service or any applicable license agreements; or (d) act in urgent circumstances to protect the personal safety of SureWest or Exent employees, users of our products or services, or members of the public.

In the event of a merger or consolidation of SureWest or Exent, or the sale of all or substantially all of its stock or assets, or bankruptcy, your personally identifying information may be transferred to the successor or assignee resulting from such events.

SECURITY
Please remember that protection of your privacy begins with you. You are solely responsible for maintaining the secrecy of any account ID or password you use to register, and you should always be careful and responsible whenever disclosing information online.

Although we will use reasonable efforts to safeguard the privacy of your information, transmissions on the Internet cannot be made absolutely secure. Accordingly, we assume no responsibility or liability for disclosure of any of your information due to errors in transmission, unauthorized third party access to information or other causes beyond our reasonable control.

MAINTAINING YOUR ACCOUNT, PERSONAL INFORMATION AND PREFERENCES
You may view and/or update your account information and preferences at any time by visiting Manage Account. If you have any questions about your account that can not be answered on the site you may contact SureWest.

Although you may cancel your subscription, we may retain your information in our files to resolve disputes, enforce our user agreement, and to meet technical and legal requirements and constraints related to the security, integrity and operation of our web sites.

All changes to the privacy policy will be posted at this URL and it is your responsibility to check the site periodically to review any changes. Your continued use of the service constitutes your agreement to any changes.
